1. Acceptance of Terms
By accessing or using Property Scanner ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Service Description
Property Scanner provides automated environmental database screening for Washington State properties. The Service searches public environmental databases and generates screening reports.
Important Limitations:
- Property Scanner is NOT a Phase I Environmental Site Assessment (ESA).
- Reports are for informational purposes only and should not be relied upon for transactional due diligence.
- The Service does not make environmental determinations or provide environmental consulting advice.
- For comprehensive environmental evaluation, consult a qualified environmental professional.
3. Beta Service
Property Scanner is currently in beta. During this period:
- Features may change or be discontinued without notice.
- The Service is provided free of charge.
- Service availability is not guaranteed.
- Data accuracy cannot be guaranteed due to third-party data source limitations.
4. User Accounts
You must provide accurate information when creating an account. You are responsible for:
- Maintaining the security of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized access.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Misrepresent Property Scanner reports as Phase I ESAs or official environmental assessments.
- Attempt to access systems or data beyond your authorization.
- Interfere with or disrupt the Service.
- Resell or redistribute the Service without authorization.
6. Intellectual Property
The Service, including its design, features, and content, is owned by Clifford Environmental LLC. You retain ownership of the property addresses you submit. Generated reports are licensed for your use only.
7. Third-Party Data Sources
The Service aggregates data from federal, state, and local environmental databases. We do not control the accuracy, completeness, or timeliness of third-party data. Data sources may be temporarily unavailable.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIFFORD ENVIRONMENTAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES RELATED TO PROPERTY TRANSACTIONS, BUSINESS DECISIONS, OR RELIANCE ON SCREENING RESULTS.
10. Indemnification
You agree to indemnify and hold harmless Clifford Environmental LLC from any claims, damages, or expenses arising from your use of the Service or violation of these terms.
11. Modifications
We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
12. Governing Law
These terms are governed by the laws of the State of Washington. Any disputes shall be resolved in the courts of Washington State.
